Teaching With Intelligence Tools — Terms of Service

Please read these Terms of Service ("Terms") carefully before using tools.teachingwithintelligence.com (the "Service") operated by Teaching With Intelligence ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the Service.

1. Use of the Service

Teaching With Intelligence Tools is an AI-powered toolkit designed for use by teachers and education professionals. You must be at least 18 years of age to create an account and use the Service.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to generate content that is harmful, abusive, or discriminatory
  • Share your account credentials with others
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Use the Service to violate any applicable laws or regulations
  • Resell or redistribute the Service without written permission
  • Configure chatbots to collect personal information from students, impersonate real individuals, or provide medical, psychological, or crisis counseling

2. Accounts

When you create an account, you agree to provide accurate and complete information. You are responsible for maintaining the security of your account and all activity that occurs under it.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Free and Paid Plans

The Service offers a free plan with limited monthly generations and a Pro plan at $9/month with unlimited generations. We reserve the right to change pricing with 30 days notice.

All payments are processed through Stripe. Subscriptions renew automatically each month until cancelled. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will not be charged for the following month but will retain Pro access until the period ends.

4. AI-Generated Content

The Service uses artificial intelligence to generate lesson plans, quizzes, and chatbot responses. You acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or omissions
  • You are responsible for reviewing all AI-generated content before using it with students
  • AI-generated content does not constitute professional, legal, medical, or psychological advice
  • We do not guarantee the accuracy, completeness, or fitness for any particular purpose of generated content

Content generated through the Service is owned by you. We do not claim any intellectual property rights over your generated outputs.

5. Student Chatbot Feature

The Custom AI Chatbot feature allows teachers to create AI tutors and share links with students. You agree that:

  • You are solely responsible for how you deploy the chatbot with students
  • You will obtain any required parental, institutional, or district consent before sharing chatbot links with minors
  • For students under 13, you and/or your school are responsible for obtaining verifiable parental consent as required by the Children's Online Privacy Protection Act (COPPA) prior to use
  • You will not use the chatbot feature in ways that violate FERPA, COPPA, or other applicable student privacy laws
  • Student conversation data is associated with your teacher account — you are responsible for monitoring appropriate use

6. Indemnification

You agree to indemnify, defend, and hold harmless Teaching With Intelligence and its owner, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your misuse of the chatbot feature with students.

7. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good faith negotiation between the parties. If a dispute remains unresolved after 30 days, it shall be submitted to binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association (AAA). Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

8. Intellectual Property

The Service, including its design, code, and branding, is owned by Teaching With Intelligence and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Teaching With Intelligence shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes via email or a notice on the Service. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
